home is expected to enter a plea this morning. darnell washington and his wife tania are charged with the murder of susie ko. they stole her car and then fled to washington state. darnell washington was extradited to conat that costa county and his wife is still being held in a washington jail. >>> san francisco police want you to look at three men charged with vandalizing a muni bus. the first suspect was wearing a black giants sweatshirt and black baseball hat. the second suspect is caucasian and was wearing black clothes and a baseball hat. the third suspect is black, last seen wearing a red jacket with stripes. police arrested 19-year-old nicholas hudson earlier this week. he is being charged with three felonies for his role in the fire that burned a muni bus. police also charged a man for smashing the bus window. anybody connected with this destruction will have to pay part of that $700,000 replacement cost. >>> chevron is laying out its plan to fix the damage from a massive fire in august. it will use chrome al loi to replace the pipes. it hopes to get all repairs done earl

could come this evening. maine is the first state to put it on the ballot. maryland and washington voters are -- asked to overturn it done by legislators. minnesota voters asked to change the constitution to define it as between a man and woman. six states have legalized it by legislation or court order. this is maryland earlier this year. 32 states have previously rejected gay marriage, proponents say they have been encouraged by national polling. 49% favor same sex marriage. maryland's turn out reported as very heavy. early returns just into the newsroom, 52% are approving same sex marriage. in maine, 53% approving it. minnesota no returns yet. the results in washington may not be known until the end of the week because of late mail in ballots. reporting live. >> now in addition to election results, reporters watching voter turn out, analysts have predict that fewer people will go to the polls this year compared to the last president alley election and david stevenson is in san francisco tonight to tell us what he is finding out about the question of turn out. >> reporter: the v

outside san jose pd, bob redell. >>> darnell washington, the fugitive accused of killing susie ko inside her hercules home last month was in court this morning where he was expected to enter a plea. nbc bay area's christie smith is live outside that courthouse in richmond with more. christie, what happened? >> reporter: good morning. this was a very brief court appearance for darnell washington. maybe lasted less than two minutes. he didn't speak or look at the row of cameras inside the courtroom facing him. the 24-year-old is accused of killing retired hercules schoolteacher susie ko. washington's attorney, the public defender, accepted the case but they did not enter a plea today. there are nine counts against him including murder, robbery and carjacking. part of a crime spree that started in southern california with his wife, tania washington, and allegedly included a jail break and wounding a deputy. prosecutors say on october 5th, they killed ko at her home. on the same day, they robbed a k-mart in sunol. they allegedly stole ko's car. ended up in washington state where they led pol
